An Accra High Court has struck out an application filed by flagbearer of the National Democratic Party (NDP), Nana Konadu Agyeman Rawlings who was seeking a judicial review of the Electoral Commissions decision to disqualify her from contesting the 2016 elections and also an infringement on her human rights due to that decision.
According to the court the rules governing the application for a judicial review is different from that of enforcement of human rights hence the two cannot be filed as one case.
They are therefore expected to drop one of the cases or file them separately. In the meantime they have been fined GHC10,000 which would be awarded to the Electoral Commission.
Lawyer for Nana Konadu and the NDP, Ace Ankomah indicated to TV3’s court reporter, Selorm Amenya that they are likely to file again hopefully by close of day.
The Electoral Commission (EC) disqualified the flagbearer of the National Democratic Party, Nana Konadu Agyeman Rawlings and 12 other presidential hopefuls for anomalies in their nomination forms.
Following the disqualification some of the parties are seeking legal redress praying the court to compel the EC to overturn its decision and place their candidates on the ballot papers.
Due to the court cases the EC has only conducted balloting for the parliamentary candidates and awaiting the final outcome of the courts before it goes ahead to ballot positions for the presidential candidates.
So far only the New Patriotic Party (NPP), the National Democratic Congress (NDC), the Convention Peoples Party (CPP) and an Independent candidate Joseph Osei Yeboah have been cleared to contest the presidential elections.
The Progressive Peoples Party (PPP) was first to file its case against the EC and judgement would be given on Friday October 28, 2016.
